1. Agreement to Terms
By enrolling your child in Old City Swim School ("OCSS," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. OCSS operates swim instruction programs at Gallaudet University, 800 Florida Ave NE, Washington, DC 20002. If you do not agree to these terms, please do not complete enrollment.
2. Enrollment & Membership
Enrollment constitutes a monthly membership. By enrolling, you agree to the following:
- I assert that my child is age 3 years or older at the time of enrollment.
- I assert that my child is fully potty trained.
- My child is enrolled in a monthly swim lesson program. They are only authorized to attend lessons at the specific time agreed to.
- Membership cannot be placed on hold, sold, transferred, or shared.
- Enrollment is for one swimmer per registration. Separate enrollments are required for siblings.
- Swimmers are placed in a level based on an initial skill assessment and may be moved between levels at the discretion of OCSS coaching staff.
- Class spots are not guaranteed until payment is confirmed.
3. Tuition & Payments
- Monthly tuition is $225 via ACH or $230 via credit card, plus applicable sales tax.
- Payments are processed automatically each billing cycle. It is your responsibility to maintain a valid payment method on file.
- All sales are non-refundable regardless of usage or personal circumstances.
- No refunds are issued for partial months, missed classes, or unused sessions.
4. ACH Recurring Payment Agreement
By registering in an OCSS monthly recurring membership program, I authorize Old City Swim School to initiate, at the time of enrollment in a specific class day and time, recurring automated clearing house (ACH) debit entries from the checking or savings account I have specified. I agree to be bound by any rules my financial institution requires for preauthorized electronic funds transfers. I understand I am responsible for all fees charged by my financial institution associated with the pre-authorized payment option. I understand I must update all changes to my checking or savings account information through my OCSS parent portal or by contacting OCSS directly.
5. Unpaid Bills
In the event that OCSS is unable to successfully withdraw funds from the checking or savings account specified in my membership account for the posted tuition balance due, I understand I may be subject to immediate termination of membership from the program and that I will be responsible for any fees or charges assessed by my financial institution.
6. Cancellation Policy
- I agree to provide at least 30 days notice from my recurring monthly bill date if I want to cancel my membership by emailing admin@oldcityswimschool.com.
- Any membership payments scheduled during the 30-day notice period will be charged as scheduled, in full, and all sales are non-refundable regardless of usage or personal circumstances.
- Until I receive a confirmation of receipt to cancel that includes the final day of membership, my notice to cancel is not confirmed.
- Swimmers who cancel lose their class spot. Re-enrollment is subject to availability and may require placement on a waitlist.
7. Closures & Unplanned Cancellations
On occasion, OCSS may be required, and reserves the right, to close because of a holiday, facility closure, weather, or major event. In the event of an unplanned closure, OCSS will hold a makeup class or discount the following month of membership equal to the missed class's value.
8. Attendance & Make-Up Policy
- Regular attendance is expected. Consistent attendance is essential for swimmer progress and safety.
- If your child will be absent for their regularly scheduled lesson and you would like to schedule a makeup lesson, you may request a session change by emailing admin@oldcityswimschool.com.
- The makeup lesson must occur within 7 days, before or after, the missed lesson.
- We plan and schedule our staff and programming ahead of time, and in order to maintain the best possible lesson experience for each and every swimmer in our program, we are not always able to fulfill the request, but we will try our best to do so.
- If your child misses a scheduled lesson, a makeup lesson is not guaranteed.
- No credits or refunds are issued for missed classes.
9. Facility & Conduct
- All swimmers and families must follow pool rules and the direction of OCSS staff at all times.
- OCSS reserves the right to remove any swimmer or family member from the facility for disruptive or unsafe behavior.
- Parents and guardians are responsible for their swimmer before and after class. OCSS staff are not responsible for supervision outside of scheduled class time.
- OCSS operates at Gallaudet University and abides by all facility rules and regulations set by the university.
10. Communication
By enrolling, you consent to receive email and text communications from OCSS regarding scheduling, class updates, billing, and other program-related information. You may opt out of marketing communications at any time, but transactional messages related to your enrollment may not be unsubscribed from.
11. Modification of Terms
OCSS reserves the right to change these terms or terminate this program at any time. Notice may be given on or with your statement or by other methods. Continued enrollment after changes are posted constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the District of Columbia. Any disputes arising under these terms shall be resolved in the courts of Washington, DC.
